By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

FaroPublicAccess offers exclusive yacht charter services, which extend to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

We can alter or cease services according to our judgement without prior notice, and service is contingent on availability and favorable weather.

3. Booking and Reservations

3.1 Booking Process

Requirements for charter reservation include:

  • A minimum age of 18
  • Providing truthful and comprehensive details
  • Paying the stipulated deposit as indicated in your booking confirmation
  • Accepting these Terms & Conditions

3.2 Confirmation

Bookings are officially acknowledged upon payment and our subsequent written confirmation. Service can be declined at our discretion.

3.3 Availability

Charter availability depends on the vessels and suitable weather conditions. We will put forth best efforts to accommodate your requested dates and times.

4. Payment Terms

4.1 Pricing

Prices are quoted in € and include any applicable taxes unless stated otherwise. Price changes may occur without prior notice.

4.2 Payment Schedule

  • Deposit: 50% of the total cost required when booking
  • Balance payment: Required 48 hours prior to the departure of the charter
  • Additional costs (if any): Due after charter service conclusion

4.3 Payment Methods

Accepted payment options include major credit cards, bank transfers, and certified cheques. All transactions are processed via encrypted, secure platforms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full return less processing fees
  • Between 24 to 72 hours prior to departure: A 50% refund
  • Within 24 hours of departure: No return of payment

5.2 Weather Cancellations

In the case of unsafe weather as determined by our captain, we offer to:

  • Postpone the charter to an alternate date at no extra fee
  • Issue a full refund should rescheduling prove unfeasible

5.3 Mechanical Issues

Should there be mechanical issues with the allocated vessel, we aim to provide a comparable replacement. If this is not possible, a full refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All passengers are expected to:

  • Comply with all directions given by the crew
  • Utilize provided safety gear as necessary
  • Inform of any health conditions that may impact their safety
  • Stay within assigned areas on the vessel

6.2 Prohibited Items

Certain items are forbidden on the yacht:

  • Glass containers
  • Illegal substances
  • Firearms or any form of weapons
  • Pets (exceptions are made if advance approval is given)

6.3 Conduct

We expect all passengers to behave in a civil manner. Any conduct that jeopardizes safety or interferes with others' enjoyment may lead to early termination of the charter without a refund.

7. Liability and Insurance

7.1 Our Liability

Our accountability is limited to the charter fee paid. We do not bear responsibility for:

  • Injuries stemming from passenger carelessness
  • Personal items that are lost or damaged
  • Indirect, consequential or punitive losses
  • Delays due to weather or situations we cannot control

7.2 Insurance Coverage

Our vessels and operations hold extensive marine insurance coverage. Participants should provide their own travel and personal insurance.

7.3 Assumption of Risk

By participating in our charter services, you recognize that maritime activities bear inherent dangers and you accept responsibility for your own safety and well-being.

8. Modifications and Itinerary Changes

We have the right to alter itineraries, courses, or timetables due to weather, safety, or operational demands. We will strive to provide similar alternative experiences.

9. Force Majeure

Our company will not be held accountable for disruptions, delays, or alterations stemming from forces beyond our control, which include but not limit to:

  • Severe weather phenomena
  • Natural catastrophes
  • Governmental directives
  • Port shutdowns
  • Vessel malfunctions

10. Privacy and Data Protection

Our handling of your personal data complies with our Privacy Policy. Utilizing our services indicates consent to our data collection and use as outlined in the Privacy Policy.

11. Intellectual Property

The content on our website, such as text, visuals, logos, and pictures, is secured by copyright and trademark regulations. Replicating, circulating, or crafting derivative material requires our express consent.

12. Governing Law

The laws within Spain preside over these Terms. Any legal conflicts will be resolved within the courts of Barcelona, Spain.

13. Changes to Terms
